RE: The tariff classification of solar panel from China

Dear Mr. Chipman:

In your letter dated June 22, 2016 you requested a tariff classification ruling.

There are two items under consideration which are referred to as Solar Panel Array components. You have provided two scenarios where the Solar Panel Arrays are being imported. The first panel is described as a collection of photovoltaic cells arranged in a panel measuring 3 inches by 4 inches with two wires extending from electrical contacts located on the back side. The panel is said to have a maximum output of 1.02 W of electricity.

The second scenario is described as consisting of the small solar panel included in the previouis scenario but with an attached controller printed circuit board assembly (PCBA) and a 3.7 Volt, 2600 mAh, Lithium Polymer Battery. The panel is said to have a maximum output of 1.02 W of electricity.

In use, the Solar Panel Arrays are incorporated into a motorized door lock where the solar panel charges the battery.

The applicable subheading for the Solar Panel Array as described in the first scenario will be 8501.31.8000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: “Electric motors and generators: Other DC motors; DC generators: Of an output not exceeding 750W: Generators.” The rate of duty will be 2.5% ad valorem.

The applicable subheading for the solar panel with the attached controller PCBA and battery will be 8501.31.8000, HTSUS, which provides for: “Electric motors and generators: Other DC motors; DC generators: Of an output not exceeding 750W: Generators.” The rate of duty will be 2.5% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
